MAKING AN OFFER

 

When buying a home, it’s important to think carefully about your offering price—but also your offering terms. Most purchase offers define both. And in some cases, terms and conditions can represent thousands of dollars in additional value for buyers—or additional costs.

 

Some buyers mistakenly believe there is a predetermined formula for offers—that offering prices should be X percent lower than the seller’s asking price or the amount they are really willing to pay. In practice, your offer price actually depends more upon the basic laws of supply and demand. If many buyers are competing for homes, then sellers will likely get full-price offers and sometimes even more. If demand is weak, then offers below the asking price may be in order.

 

LEGAL ISSUES OF BUYING A HOME IN TEXAS

 

Selling a home is a lengthy process that may involve navigating a number of local, state, and federal laws. Your Realtor is an expert who can guide you through all legal concerns that pertain to the transaction.

 

Offer Contingencies

 

After the buyer has presented an acceptable offer, you have tasks to perform and options to protect your interests in the deal. In Texas, the three standard contingencies are:

 

Financing Contingency

 

Before the sale is considered final, the buyer must provide proof that they have secured a loan towards the purchase. This contingency allows the buyer to rescind their offer if financing does not materialize, and their earnest money refunded.

 

Inspection Contingency

 

The buyer is allowed to procure a licensed home inspector at their own cost–This is done during the ‘Option Period’. The final sale may depend on either the property conditions meeting the buyer’s satisfaction, or buyer may negotiate repairs to be done by the seller, or be given certain additional credits or agreements based on the results of the inspection.


Title, Homeowners Association And Survey Contingencies

 

Once the buyer and seller’s brokers have organized the terms of the contract offer, buyers are permitted to have all the title and HOA documents and survey,  examined. Your Realtor may then advise their clients to either accept the deal, reject the deal, or suggest altered terms.
